제5장 특허권 <개정 2014. 6. 11.>

제88조(특허권의 존속기간)

① 특허권의 존속기간은 제87조제1항에 따라 특허권을 설정등록한 날부터 특허출원일 후 20년이 되는 날까지로 한다.

② 정당한 권리자의 특허출원이 제34조 또는 제35조에 따라 특허된 경우에는 제1항의 특허권의 존속기간은 무권리자의 특허출원일의 다음 날부터 기산한다.

CHAPTER V PATENT RIGHTS

Article 88 (Term of Patents)

(1) The term of a patent shall begin on the registration date of the grant of the patent right under Article 87 (1) and last for 20 years from the filing date of the p atent application.

(2) Where a patent is granted for a patent application filed by the legitimate right-holder under Article 34 or 35, the term of the patent under paragraph (1) shall begin on the day immediately following the filing date of the patent application filed by the unentitled person.
